Konkordato ilan eden borçlunun alacaklıları: süreç neden yakından takip edilmeli?Creditors of a debtor in concordat: why the process must be followed closely

5. Takip edilmeyen dosyada riskler artar
Süreç izlenmezse alacağın uzun vadeli taksitlere bağlanması, borçlunun varlıklarının başka alacaklıların ödenmesine gitmesi veya alacağınızın beklediğinizden daha az karşılanması gibi sonuçlarla karşılaşılabilir. Konkordato her dosyada aynı sonucu doğurmaz.
6. Her alacak türü farklıdır

Concordat is a legal route that allows a debtor to restructure its debts under court supervision and the oversight of a commissioner. When a company files for concordat, the position of its creditors depends largely on how the case is run. A creditor may be a supplier, a bank, an employee, or a real estate buyer under contract with the company. Whichever you are, following the file and filing petitions when needed is in your own interest.
1. Pay attention to the file early
During the provisional moratorium, enforcement against the debtor is stayed. Taking no part in the case at this stage may waste an important period in which a creditor can exercise its rights. The first step is to learn which court holds the file, when the moratorium began and what stage the case is in.
2. Review the debtor's real financial position
The concordat project rests on the debtor's own statements and may present its position in the best possible light. Financial statements, asset and debt lists, the value of real estate and dealings with related parties should be read carefully and compared with the commissioner's reports.
3. Check the creditors' list and claim amounts
The amount, basis and genuineness of each claim should be assessed individually. Who is listed as a creditor, and for how much, shapes both the payment plan and the weight of creditors relative to one another. Make sure your own claim is listed correctly.
4. The commissioner and the court rely on the documents before them
The commissioner and the court decide on the information and documents in the file. A creditor's information should be submitted through properly drafted petitions filed on time. A step not taken within the time limit may cost a right.
5. Risks grow when the file is not followed
If the process is not monitored, outcomes can include a claim paid in long instalments, the debtor's assets going to satisfy other creditors, or a recovery lower than expected. Concordat does not lead to the same result in every case. A well-managed process can also protect creditors' rights.
6. Each type of claim is different
Secured claims, ordinary commercial claims, employee claims and claims arising from real estate sale contracts are subject to different rules. Strategy should therefore follow the nature of your own claim. Short time limits and strict procedure in concordat files make following the case through a lawyer important.
